Jeff Galindo was convicted, following a jury trial, of statutory sodomy in the first degree, § 566.062, RSMo 1994. Defendant was sentenced as a prior and a persistent offender, ■§ 558.016, RSMo 1994, to life imprisonment. The jury found that Galin-do sodomized a four-year-old girl that he was babysitting. Following his direct appeal and this Court’s affirmation of his conviction and sentence, Galindo filed a motion for post-conviction relief under Rule 29.15, Missouri Court Rules (1998).
