OPINION AND JUDGMENT

DALTON, Chief Judge.

This proceeding involves a petition for a writ of habeas corpus filed in forma pauperis on June 12, 1968, by Chester A. Hawks, a prisoner of the State of Virginia.

Petitioner was convicted in the Carroll County Circuit Court on January 6, 1959, of murder in the first degree. No appeal was taken, but petitioner has *95filed several petitions in both the state and federal courts to secure a writ of habeas corpus.
