Joseph M. Gardiner, III, (Joe) appeals the district court’s award of attorney fees to Krigel and Krigel, P.C., (Krigel & Krigel) attorneys for J’Noel Gardiner. This is a companion case to In re Estate of Gardiner, (29 Kan. App. 2d 92, 22 P.3d 1086 (2001). In *159that case, this court reversed the trial court’s granting of summary-judgment and ruled that the matter be remanded for a hearing.

Marshall G. Gardiner died intestate on August 12,1999. He was a resident of Leavenworth County, Kansas.
