In an action to recover damages for personal injuries, the defendant Alfonso Longo appeals from an order of Supreme Court, Kings County (Held, J.), dated May 8, 2008, which denied his motion for summary judgment dismissing the complaint insofar as asserted against him.

Ordered that the order is affirmed, with costs.

The plaintiff allegedly was injured when the water running from the faucet in his bathtub suddenly became extremely hot, causing serious burns to his ankles and feet. He subsequently commenced this action against the owners of the subject building, alleging, among other things, that…
