This was an action commenced by the plaintiff in error, plaintiff below, against the defendant in error, defendant below, for compensation for services performed by him as register of deeds of McIntosh county in relation to the transfer of the old Indian Territory registration records to the office of the register of deeds of the state, under section 1741, Comp. Raws 1909, which provides:
