1Opinion of the CourtGreenberg, J.

This is an appeal by the petitioner, John N. Zullo, from the denial of habeas corpus relief. The case was heard in the Superior Court on the basis of undisputed documentary evidence upon the respondent’s motion for summary judgment. Everything that was presented to the trial judge, therefore, is in the record before us, and we may arrive at our own conclusions of law. See Mahony v. Assessors of Watertown, 362 Mass. 210, 211 (1972); Richardson v. Lee Realty Corp., 364 Mass. 632, 634 (1974); Foxborough *372v. Bay State Harness Horse Racing & Breeding Assn., 5 Mass. App. Ct. 613, 615 (1977).
