Whatever may he said concerning this proceeding, it is certainly novel. We can find no precedent for it, and we know of no principle of law upon which it can be upheld.
Bell McKinnon, Gay Clifton McKinnon and Jesse Mc-Kinnon filed a complaint in the district court, the allegations of which were that Bell was the widow, and Gay Clifton and Jesse were the children of John McKinnon who died in 1889.
