OPINION
WINE, Judge.
Corey Richardson (“Richardson”), an inmate at Eastern Kentucky Correctional Complex (“EKCC”), brings this appeal, pro se, from a judgment of the Morgan Circuit Court entered April 4, 2008, where by the court entered an order dismissing Richardson’s petition for declaration of rights. No subsequent motion to alter, amend or vacate the April 4, 2008 judgment was filed. After a thorough review, we affirm in part and reverse and remand in part.
