This is an action for damages for personal injuries, brought under the federal Employers’ Liability Act of April 22, 1908 (35 Stat. at L. 65, c. 149 [U. S. Comp. St. §§ 8657-8665]).
The action was originally instituted against Walker D. Hines, Director General of Railroads of the United States, and judgment was rendered in his favor, dismissing plaintiff’s suit. Plaintiff appealed from the judgment, and in this court James C.
