Berman, J.), entered on or about April 26, 1989, convicting defendant, after a jury trial, of criminal sale of a controlled substance in the third degree and criminal possession of a controlled substance in the third degree, for which she was sentenced as a second felony offender to concurrent indeterminate terms of A-Vi to 9 years, unanimously reversed, on the law and as a matter of discretion in the interest of justice, and the matter remanded for a new trial.
