Appeal from a judgment of the Supreme Court, entered March 21, 1975 in Ulster County, upon a dismissal of the complaint by the court at a Trial Term at the close of the plaintiff’s case. On the night of May 28, 1972, two police officers of the City of Kingston responded to a call which advised them that a group of men were causing a disturbance. When they arrived, they found several men, including the plaintiff, arguing among themselves and the men were apparently given the choice to either move along or be arrested.
