OPINION
CASTILLO, Judge.
{1} In a previous unpublished memorandum opinion, this Court affirmed the aggravation of Defendant’s sentence. Defendant petitioned the New Mexico Supreme Court for a writ of certiorari, which was denied. Subsequently, Defendant filed a petition for writ of certiorari in the United States Supreme Court, which granted Defendant’s petition, vacated the judgment, and remanded the case to this Court for further consideration in light of Cunningham v.
