CRANE, Presiding Judge.

Real estate seller appeals summary judgment in favor of buyers on their petition for return of earnest money deposited pursuant to a residential real estate sale contract. We reverse and remand for the reason that buyers waived the financing contingency to the contract and therefore were not relieved of their obligations under the real estate contract when they failed to obtain financing.
