¶ 1. In September 2001, Byron L. Brown suffered injuries during his employment at Marshal Durbin.1 Brown‘ returriéd to work and coiitinued to work for Marshal Durbin until his retirement in 2008. Significantly, Brown retired without seeking alternative positions from Marshal Durbin. Brown' thereafter filed a claim to receive disability compensation, alleging that the worsening of his injuries from 2001 left him unable to continue working.
