Appeal from Circuit Court, Butte County. Hon. W. G. Rice, Judge. Aimer E. Stumbaugh was convicted of manslaughter in ihe first degree, and he appeals.

Upon an information duly filed by the state’s attorney of Butte county, the defendant was charged with the crime of murder in the killing of one Louis Arpan, on the 2l'st day of June, 1910. To this information the defendant pleaded not guilty, and upon the trial was found guilty by the jury of *52manslaughter in the first -degree, and sentenced by the court to 12 years’ imprisonment in the state penitentiary. From this judgment, order denying a new trial, and order denying motion in arrest of judgment, the defendant has appealed to this court.
