— Appeal from a judgment of the County Court of Ulster County (Clyne, J.), rendered December 12, 1980, upon a verdict convicting defendant of the crime of unlawful imprisonment in the second degree. Defendant was charged in an indictment with attempted rape in the first degree, sodomy in the first degree and unlawful imprisonment in the first degree.
