KING, Circuit Judge:
Charles A. Bly appeals from the district court’s refusal to dismiss the portion of an indictment charging him with a violation of 18 U.S.C. § 876(b) (the “ § 876(b) Offense”). Pursuant to a plea agreement, Bly entered a conditional guilty plea in the Western District of Virginia to the § 876(b) Offense, reserving his right of appeal.
