MEMORANDUM OPINION

EMMET G. SULLIVAN, District Judge.

Pending before the Court is defendant Vernard Mitchell’s Motion to Vacate, Set Aside, or Correct Sentence Pursuant to 28 U.S.C. § 2255. Because it appeared to the Court that Mr. Mitchell raised arguments for a reduction of sentence pursuant to 18 U.S.C. § 3582(c), the Court ordered the Government to address both statutory provisions in its response.
