Sam Collins filed with the Industrial Commission an application for the adjustment of his claim, which he charged arose out of an accidental injury suffered on January 11, 1923, while employed by the Valier Coal Company. On the hearing before the arbitrator it was stipulated that the parties were subject to the provisions of the Workmen’s Compensation act. The arbitrator found that Collins was not entitled to compensation because notice of the accident had not been given within the time prescribed by the act and his condition was not the result of the accident.
