KRUEGER, Judge.

The offense is murder. The punishment assessed is confine-: ment in the state penitentiary for a term of twenty-five years.

Appellant, Eddie Valmore, Arnold Herbert Lockley, Toby Junior Duhon and Wesley Fregia were jointly indicted and charged with the murder of E. L. Manning. A severance was applied for which was granted and appellant was placed on trial alone.

Appellant filed two separate and distinct motions to quash the indictment. In his first motion, he charged that he was a negro; that the jury commissioners who selected the grand jury deliberately and designedly refused…
