The defendant is charged with a violation of section 1751 of the Penal Law in that he did have in his possession and under his control a quantity of narcotic drugs, canabis sativa, commonly known as marijuana. The defendant moves for an order suppressing certain evidence seized by the police at the time the defendant was apprehended, or in the alternative that the matter of suppression of such evidence be set down for a hearing before the court.
