The plaintiff alleges in his petition that he is the unqualified owner, and entitled to the present, possession, of certain cattle, sufficiently described in the petition ; that he acquired the ownership of the cattle by a written pledge to secure the payment of *459seven hundred and ten dollars, and that he took possession of the property under such writing and the oral assent of the owners.
