This is an action, commenced October 17, 1929, upon a contractor’s bond, dated June 4, 1928, signed by the defendant Powers, the contractor, as principal, and the defendant ¡Union Indemnity Company, as surety, for faithful performance by the contractor of a contract entered into between him and the plaintiffs, trustees of school district No. 1, McClellanville, S.
