Defendant Phillip Damon, after a nonjury trial, was found guilty of possessing a controlled substance, heroin, in violation of section 402 of the Controlled Substances Act (Ill. Rev. Stat. 1971, ch. 5672, par. 1402), and was sentenced to a term of nine months in the Illinois State Farm at Vandalia, Illinois. He appeals, arguing that the trial court erred in denying his motion to suppress evidence which he contended was obtained as a result of his being illegally arrested.
