OPINION

GLENN A. NORTON, Judge.

Howard Leventhal (“Defendant”) appeals the judgment entered upon a jury verdict finding in favor of Gene Schenberg (“Plaintiff’) on Plaintiffs claims of abuse of process and malicious prosecution. Plaintiff filed a motion to strike Defendant’s brief and dismiss his appeal. We took the motion with the case. We agree that Defendant’s brief fails to comply with Rule 84.04 1 and therefore dismiss the appeal.
