MCCLURE, District Judge.
BACKGROUND:
On November 27, 2002, plaintiffs David Angstadt and Barbara Angstadt, husband and wife, acting on behalf of their minor child Megan Angstadt (Megan), commenced this action with the filing of a four-count complaint against defendant Midd-West School District (Midd-West) under 42 U.S.C. § 1983. Plaintiffs allege that Midd-West, by refusing to allow Megan, a student at Western Pennsylvania Cyber Charter School, to practice, play and compete in interscholastic basketball, is acting in violation of her First and Fourteenth Amendment rights.
