OPINION AND ORDER

CASELLAS, Senior District Judge.

Before the Court is Petitioner’s motion to vacate, set aside, or correct sentence pursuant to 28 U.S.C. § 2255 (Docket # 1). On April 5, 2005 the Court referred this case to Magistrate-Judge Camille Vé-lez-Rivé for a Report and Recommendation (Docket #6). On June 15, 2005 Magistrate Vélez-Rivé issued her report, recommending that the petition be denied and the case be dismissed with prejudice (Docket # 7).
