This is an action brought by petition filed December 23, 1889, for the recovery of fees due plaintiff as clerk of this court for services rendered by him on behalf ofthe United States between July 1,1887, and the date of the filing of the petition. The proceeding is instituted under the provisions of the act of congress approved March 3,1887, (24 St. 505,) and all the jurisdictional requirements of the statute seem to have been complied' with. The defendant, for answer to this petition, admits the performance by the clerk of all the services the fees for which are here sued for, but denies…
