According to the findings of fact by tne court below, the shutters, the value of which is sought to be recovered in this action, were furnished by plaintiff, and affixed to the building of defendants, which was then occupied by them, *412between the 19th day of June and the 10th day of July, 1878, under a special agreement .containing a precedent condition that they should conform to a certain designated sample, in pattern, description and quality, else defendants would not be required to take and pay for them; and they were wholly unlike the sample in all respects.
