When this proceeding was instituted petitioner and the other persons named in the petition (referred to herein as “ petitioners ”) were provisional employees of the board of transportation of the city of New York serving as street car operators on the surface lines of the city’s transit system. They sought to retain their positions by preventing the appointment of eligibles from the civil service list of automobile engineman on the ground that such list is not appropriate for appointment to the position of street car operator.
