On the 1st day of May, 1890, the appellant was in possession of the premises, No. 151 Clark street, in the city of Chicago, holding over from a demise of which the following receipt was the evidence:

“Received of James V. Webb rent for 151 Clark street, same being for one month, ending April 24, 1890, $100.

Hathaway, Soule & Harrington,

T. H. Chamberlain.”

The appellee then had a lease from the landlords of the appellant, dated February 12, 1890, for a term beginning May 1, 1890, and ending April 30, 1892.

The appellant was wrongfully in possession, his term having expired. He was a trespasser.…
