The defendant in error, Ernest C. Mires, filed his bill in this case in the circuit court of Livingston county for the partition of 120 acres of farm land and for the assignment of dower therein to his mother, Louise F. Mires, alleging that the land was owned by his father, Frank W. Mires, at the time of his death, on September y, 1912, and descended to his sister, Pearl L.
