As stated in appellant’s brief, this is a suit in trespass to try title, brought by her against J. B. Moseley to try title to five acres of land; out of the M. Martinez two-league grant in McLennan county. Ap-pellee Moseley, having vouched in his war-rantor, C. Simons, pleaded not guilty, and specially pleaded the several statutes of limitation, and, further pleading his purchase of the land in controversy as part of a larger tract from his warrantor, C. Simons, prayed that if judgment be rendered against him for said land, or any part thereof, that he have judgment over against his warrantor…
