This same matter and controversy involving the same parties was before the district court of Powell county in district court cause No. 2839 therein commenced July 12, 1939. It was likewise before this court on appeal in this court’s ease No. 8405, wherein by decision and final judgment pronounced April 15, 1944, this court directly adjudged the issues both of fact and of law, against the defendant and cross-complainant John E.
