Appeal, by the relator, James .Campbell, from an order of the Supreme Court, made at the Kings County Special Term and entered in the office of the clerk of the county of Kings on the 13th day of April, 1903, denying the relator’s motion for a writ of peremptory mandamus.

This is an appeal by the relator from an order denying a motion for a peremptory writ, of mandamus, commanding the respondent as police commissioner to recognize the relator as telegraph' operator of the police department of the city of New York, from the 2d day of August, 1900, with the rank and compensation of a sergeant of police from that time. The relator was appointed a patrolman of the police force of the mayor, aldermen and commonalty of the city of New York in 1891, and by virtue of the consolidation became, on January 1, 1898, a member of the police force of the city of…
