Warren, District Judge.

The defendant was convicted by a jury and sentenced to a term of 15 to 20 years for the crime of assault with intent to commit great bodily injury, occurring on September 29, 1970. On direct appeal, the conviction was affirmed. State v. Fincher, 188 Neb. 376, 196 N. W. 2d 909 (1972). Defendant then appealed from denial of post conviction relief alleging two grounds for relief: (1) The propriety of jury instructions on an insanity defense; and (2) claimed ineffectiveness of counsel.
