This action is one for a declaratory judgment adjudicating that an amendment to section 327 of the Sanitary Code of the City of New York, adopted by the Board of Health on August 10, 1943, is unconstitutional. The amendment in question constitutes subdivision 4 of section 327, and reads as follows: “ 4.'
