DALLAS, Circuit Judge.
This writ of error has brought up the record in an action which was instituted by the plaintiff in error against the defendant in error, upon a policy dated November 9, 1903, insuring the life of Samuel R. Hews, who was the plaintiff’s husband. The defenses were that the policy had been fraudulently procured, and that the application contained statements which were warranted *851to be true, but which in fact were untrue.
