OPINION

{¶ 1} Defendant-appellant, Ricky J. Bates, appeals from a decision of the Belmont County Court, Eastern Division convicting him of assault and ordering him to pay restitution to the victim.

{¶ 2} On September 26, 2002, appellant was enjoying a night of drinking with Alice Worley, Allen Craig, Charlene Griffin, and Crissy Leek. The group was in front of Griffin's house on Rosser Avenue in Bellaire. At some point in the night, Ricky Givens also joined the group.
