Appeal from an order of the Supreme Court at Special Term entered November 28, 1966 in Rensselaer County, which granted a motion by plaintiff for summary judgment, and directed a jury trial on the issue of damages. (Memorandum decision on prior appeal 25 A D 2d 706.) The appellant, Peterson-Ashton Fuels, Inc., formerly known as Peterson-Packer Fuels, Inc., leased certain real property on the westerly side of Front Street in the City of Troy from the Boston & Maine Railroad by indenture of lease dated September 10, 1909, and erected certain buildings or structures thereon…
