This appeal was filed in the Supreme Court, but was transferred to this court upon the basis that it is a partition proceeding and thus within our jurisdiction.

The summary judgment appealed from by Marsha Hughes (with essential deletions made for brevity) provides: “Frances Hughes and Tommy Franklin Hughes were lawfully married in 1959 and lived together as husband and wife until 1978.
