Appellant was charged by way of information, filed in the St. Louis court of Criminal Correction, with unlawfully taking and agreeing to take and receive from Harry E. Favers the sum of $8.60 as interest for the forbearance and use of $25.00 for the period February 11, 1949, to May 20, 1949. A jury was waived and the case was submitted to the court. Appellant was found guilty by the court and his punishment was assessed at sixty days in the City Workhouse and a fine of $250.00.
