The plaintiff has recovered a judgment for a large amount against both of the defendants as damages for personal injuries. The accident in which the injuries were suffered occurred on the 8th day of February, 1929, at the corner of Elmwood avenue and Virginia street in the city of Buffalo. On the afternoon of that day, plaintiff was riding, as a passenger, in a light delivery truck when the cover of a manhole which the truck had just passed was blown- into the air by an explosion occurring in the manhole.
