—The above matter comes before the court on the preliminary objections of defendant Monroeville News Co., Inc. t/d/b/a The Monroeville Newsstand, a corporation (hereinafter Monroeville News), to the complaint in equity of the municipality of Monroeville (hereinafter Monroeville), wherein both preliminary and permanent injunctions were sought to restrain the sale of certain publications alleged to be obscene and a “public nuisance” under the provisions of an ordinance effective July 31, 1976.
