Brockett Pointe Shopping Center, Ltd. (“Brockett Pointe”) brought an action against Development Contractors, Inc. (“DCI”) to vacate an arbitration award entered in favor of DCI. Brockett Pointe alleged that the arbitration award is not enforceable because one of the three arbitrators was improperly appointed. DCI responded and sought to confirm the arbitration.
