The action‘is founded on the Employers’ Liability Act and brought to recover damages for injuries alleged to have been caused by the negligence of defendant’s superintendent.
The complaint alleged that defendant employed a certain two-wheeled truck with a lever attached to the center of the axle for the purpose of picking up iron and steel beams from the ground by means of a chain attached to said lever and transporting them in and about the building of a subway.
