The plaintiffs, Paine, Webber & Co., are .and were a partnership engaged in selling securities. The Capital Trust & Savings Bank is a trust company of Minnesota, and was, up to May 3d of last year, at which time it was closed by the superintendent of banks, engaged in business as sueh. The Trustees of Maealester College is and was a corporation engaged in maintaining an educational institution, and will be referred to as “the eollége.” Por a considerable length of time prior to May 1,1924, the college had been purchasing securities from the trust company and…
