Before the Court is Defendants’ motion to dismiss (Docket # 12), which Plaintiff opposed (Docket # 13). 1 For the reasons set forth below, Defendants’ motion is DENIED.
Background
On November 13, 2000, Plaintiff filed the above-captioned action, and. subsequently requested a preliminary injunction on December 26, 2000. Plaintiffs action claims that Defendants have violated Licensing Agreements entered between Sabroso Publishing and Caiman Records to manufacture and sell certain musical compositions.
