Justice SUTTELL, for the Court.

We consider in this case whether a defendant who has been convicted previously in the State of New York of second-degree felony murder, the predicate felony being kidnapping, also may be tried in Rhode Island for the same kidnapping, or whether the- Rhode Island prosecution places him twice in jeopardy for the same offense in violation of both the United States 1 and Rhode Island Constitutions. 2
