The basis of this action in tbe court of common pleas was the unlawful breaking and entering of tbe dwelling bouse of defendant in error, Alta Lowery, during tbe absence of herself and ber husband, by tbe plaintiff in error, tbe M. J. Rose Company, and tbe removal therefrom of certain furniture owned by plaintiff and ber husband.
